The New Jersey Continuing Legal Education Center and the New Jersey State Bar Association are co-sponsoring a seminar exploring the legal and ethical pitfalls in e-discovery.
The seminar will be held at the New Jersey Law Center on Monday, July 12, at One Constitution Square in New Brunswick, New Jersey.
The program will run from 9:00 a.m. until 12:30 p.m.
Nearly all discovery is e-discovery, and the proliferation of technology has served to expand the areas that could potentially have discoverable information. At the same time, the line between workplace and non-work-related matters has become blurred due to the widespread use of social networks sites and private email in the workplace.
Participants will learn of the expansion of Zubulake and what they must do to avoid sanctions and RPC violations in light of personal email and social networking in the workplace. Topics will include the reasonable expectations of privacy for personal emails exchanged on company-issued computers, how judges interpret the new requirements, and insights by the bench on compliance pitfalls.
The faculty will discuss the recent expansion of cases awarding sanctions and how to avoid them and will examine the "zone of privacy" surrounding an employee's personal email.
The speakers include James P. Anelli, LeClair Ryan; Brett Anders, Jackson Lewis LLP; and Ian D. Meklinsky, Fox Rothschild LLP.
