The New York County Lawyers Association will offer a program, Alternative Litigation Financing: A New Way to Help Pay for Lawsuits and Stay Out of Trouble While Doing It, on Wednesday, September 14, at the NCYLA Home of Law at 14 Vesey Street in New York City. It begins at 6:00 and ends at 9:00 p.m.
With the costs of litigation skyrocketing, more and more potential commercial and tort litigants are exploring their options to seek alternative means to finance their lawsuits. While such arrangements are widespread and have been occurring for years, the recent proliferation of dedicated investment funds have brought heightened attention to the practice - as well as raised significant ethical questions about such arrangements.
A distinguished panel of litigators, ethicists and providers of litigation financing will discuss the facets of this hot button issue. The faculty will use hypotheticals including how litigation financing is arranged; the state of the law of champerty; the state of alternative litigation nationwide and in England, including U.S. legislation - both proposed and enacted - dealing with the subject; using alternative litigation financing in practice - a litigator's perspective; and ethical issues arising in the use of alternative litigation financing.
